California Goes Farther to Protect Employees from Labor Law Violations

California employees may be eligible for overtime pay whether or not the overtime was authorized. The California Department of Industrial Relations states that overtime must be paid one and one half times an employee’s regular pay rate for hours more than 8 hours per day or more than 40 hours per week. Overtime pay may go up to two times an employee’s regular pay rate when working more than 12 hours per day.

Middle managers, stock brokers, and computer software employees are especially at risk of unpaid overtime in California. To qualify for overtime pay, employees must be classified as non-exempt by meeting the requirements of a duties and pay rate tests.
