A Hagerstown business refused to hire a 60-year-old Clear Spring man because of his age, the U.S. Equal Opportunity Commission alleges in a federal lawsuit.
Clarence Stottlemyer claims he interviewed on April 2 for a job at Hub Labels Inc., a privately owned label-manufacturing firm, and was assumed to be unable to do the heavy lifting required, EEOC lawyer Debra Lawrence told The (Hagerstown) Herald-Mail for a story published Thursday. Stottlemyer is seeking a job at the plant with back pay, and an order requiring the company to train employees in laws prohibiting age discrimination.
Company officials declined to comment on the lawsuit because they had not received a summons, The Herald-Mail reported.
The complaint was filed Sept. 26 in U.S. District Court in Baltimore.
Lawrence said a shift supervisor a the plant refused Stottlemyer's offer to prove he could lift in excess of 40 pounds, as required by the job.
